REGULATIONS for Registration of a .KG Domain Name

TERMS USED:

DOMAIN - zone of Internet hierarchical names that is serviced by a set of Domain Name Servers (DNS) and is provided with centralized administration. A domain has its identification name.

.KG - two-alphabetical code of the Kyrgyz Republic according to International ISO-3166 Standard.

DOMAIN REGISTRATION - receiving and registering information about the domain and its Holder in Domain Name Database (DND) in order to ensure the uniqueness of the domain name and also to receive the rights for the Domain Holder to administer the domain name. The domain name registration service is considered to be provided from the time it was registered in DND.
The domain name is considered to be registered for one- year period from its registration date.

DOMAIN DELEGATION – granting the right to use a .KG domain (domain name) during the account period, receiving and registering the data about the domain name and corresponding domain name servers (DNS) specified by the domain name Holder into .KG zone thus providing functioning of the domain name within the frame of International Internet System.

ADMINISTRATOR - a legal entity that provides a .KG domain name registration and maintenance services to the domain name Holder during a paid-up account period.

DOMAIN NAME HOLDER - a legal entity or a natural person that registers a domain/domains and enters information into the Registration form.
The domain name Holder is also its payer.
The domain name Holder establishes:
-the procedure of the domain use;
-the organization being responsible for technical support of the domain name;
The domain name Holder himself is responsible for choice of the domain name, possible infringement of a trademark right, copyright and other rights as well as conflicts over the domain name use.
The domain name Holder chooses and registers an individual password for having an access to the domain information and is responsible for all the actions regarding the use of his password.

REGISTRATION FORM–a form that has to be filled in at: www.domain.kg

ACCOUNT PERIOD - a one-year period during which the information about the domain is to be stored in DND. The date of the domain name registration is considered to be the beginning of the first account period.
In case of the domain name re-registration the next account period starts on the same date of the next year.

ADMINISTERING A DOMAIN - establishing the order of the domain use, providing the domain name technical support, arranging payment for the domain operation service.

DOMAIN NAME RE-REGISTRATION – updating of information about the domain name after termination of the account period. The domain name re-registration ensures the renewal of the domain delegation period for the next account period.

DOMAIN NAME RE-DELEGATION - organizational and technical measures on transferring domain name administration rights to another domain name Holder.

TECHNICAL SUPPORT OF A DOMAIN - technical actions aimed at ensuring the domain operation (a domain name server capacity, timely delivery of information required for the domain normal operation).

1. GENERAL PROVISIONS OF ADMINISTERING THE .KG ZONE

ASIAINFO LTD.(hereinafter referred to as the Administrator) provides the .KG zone administration. The .KG zone Administrator is authorized to administer the .KG zone by Internet Corporation for Assigned Names and Numbers (ICANN).

The Administrator provides administration of the .KG zone based on available at his disposal technical facilities according to the present Regulations.

A domain name (domain names) is/ are registered via the Internet Registration form at: www.domain.kg or by making a contract with the Administrator.

All the information about the registered .KG domain names is supported in the Domain Name Database and is accessible in the Internet at:www.whois.kg and www.domain.kg

When registering the domain, the domain name Holder shall confirm that he won't violate and won't restrict the rights of any third party. The domain name Holder is responsible both for possible infringement of a trademark, name, copyright, etc. of any third party and for conflict situations as to using domain names of other institutions.

All the contacts specified in DND shall be accessed by email given in the Registration form. In case of inaccessibility of contacts by email the Administrator does not bear any responsibility for failure to receive information messages sent to them.

If the domain name Holder gives a non-complete or inadequate information during a domain /domains registration and the payment is not made within the time stipulated in the Regulations, the registration is considered to be invalid.

A domain name and the right to administer the domain name are not considered to be the object of purchase and sale.

2. PROCEDURES OF REGISTERING THE .KG DOMAIN NAME

To register a domain name it is necessary to enter the information about the domain name Holder via the Internet Registration form at: www.domain.kg or make an agreement with the Administrator.

After the domain name/domain names have been checked for their uniqueness during primary registration, the domain name is registered in Domain Name Database and has INACTIVE status until payment for the domain has been made.

The Proforma Invoice for registration services shall be sent to the email address specified by the domain name Holder within three (3) working days from the domain registration date. In case of failure to receive the Proforma Invoice within three days from the domain name registration date, the Holder should apply to the Billing Department by sending email at: billing@infotel.kg or call at: +(996) 312 66 44 88.

In case the domain name registration fee has not been received at the Administrator account within thirty (30) calendar days from the domain name registration date, the domain name is automatically cancelled. The cancelled domain name can be assigned to any other customer.

The registered domain name becomes activated within three (3) working days from the receipt of 100% payment to the Administrator account (if the domain name has not been cancelled) on conditions that the domain name Holder will send an obligatory written notification as to payment affected. After payment has been affected, the domain acquires the status ACTIVE for the paid-up account period.

The domain name Holder shall effect payment in accordance with paragraph 6 of the Regulations and current rates. Payment for domain name registration ensures the information storage concerning a registered domain name in the Domain Name Database during the paid account period.

Payment for the domain/domains re-registration ensures the information storage about the re-registered domain/domains for the next paid account period.

Domain name/domain names are not registered in the following cases:
Domain name/domain names have already been registered;
Domain name/Domain names do not conform to item 3.3 of the Regulations.

3.TERMS AND CONDITIONS OF DOMAIN REGISTRATION AND DELEGATION

A domain name can be registered and delegated only if at least two domain name servers (primary and secondary DNS) providing support of a delegated domain name are available. At the same time at least two of them must be located in different IP-networks (in different category C networks according to conventional terminology) and must be provided with reliable connection to the Internet. "Reliable connection" means the connection when the total time during which there is no connection with a server does not exceed two hours a day.
The information about the domain name servers shall conform to the network current state.

A domain name must consist of one and more than one symbols, begin and end with a letter of Roman alphabet or a digit. Letters, digits or a hyphen can be used as intermediate symbols.
The Administrator is authorized to suspend delegation of the domain immediately based on:
- an official message from the domain name Holder;
- the Law of the Kyrgyz Republic;
- an application from a domain technical support service if after changing the information about domain name servers which support domains (Name Server1 and Name Server space) the terms and conditions in item 3.1 of the Regulations are not met.

In case of failure to fulfill items 3.1, 3.2 of the Regulations within more than one month the Administrator has the right to suspend delegation of the domain name until the server maintenance violations have been eliminated. In this case the fee for a suspended period of time is not paid back and the commencement date of accounting period is not changed. During suspension of the domain name delegation all the rights for administering the domain belong to the domain name Holder.

In case the information about a legal entity or private individual contained in Domain Name Database becomes invalid (is changed) it has to be updated by the domain name Holder within one month at most from the date of its change.

In case the information about a legal entity or about a private individual in the .KG Domain Name
Database differs from the actual one, such as:
-invalid legal address of the organization;
-invalid mail address of the organization or private individual;
-invalid name of the organization;
-invalid name, patronymic name, surname, the domain name Holder bears responsibility for non-receipt of information about a domain name/domain names (i.e. termination of an account period, changes about delegating conditions etc.).

In case the domain name Holder infringes trademark, name rights, copyrights, the law of the Kyrgyz Republic, etc. the Administrator has the right to stop delegating the domain until the information has been specified or to cancel it in pursuance of the court decision or other circumstances. In case the domain name Holder violates the rights of any third party or the law of the Kyrgyz Republic, payment for domain registration and re-registration is not paid back.

In case the documentary confirmation as to the validity of the information contained in Domain Name Database is to be provided on the request of the Administrator, a legal entity or a natural person has to provide a documentary confirmation about the information accuracy within one month at most from the date the first request was sent. Requests should be e-mailed by the Administrator to the domain name Holder contact address in the Domain Name Database.

In case of failure to fulfill items 1.5, 3.7, 3.9 of the Regulations the Administrator has the right to stop delegating the domain/domains which contain references about a legal entity or a natural person when the information about them becomes invalid or requires confirmation. The Administrator shall renew a domain/domains delegation procedure within three (3) working days from the date of new information delivery or confirmation delivery concerning its validity.

In case a legal entity or a private individual fails to provide the requested information or fails to confirm the validity of the information available in DND in accordance with the Administrator's request, the domain name/names are considered to be cancelled.The funds for work regarding domain name/domain names registration or re-registration are not paid back to the domain name Holder.

4.DOMAIN NAME RE-REGISTRATION PROCEDURE

A domain name can be re-registered after 100% service payment. The Administrator shall send a domain re-registration Proforma Invoice to the domain name Holder at email contact address before termination of the account period.

In case of failure to receive the re-registration Proforma Invoice within thirty (30) days before termination of the account period the domain name Holder has to apply to the Billing Department at: billing@infotel.kg or by phone: +(996) 312 664488.

The domain name Holder shall pay for domain re-registration services in accordance with paragraph 6 of the Regulations.

Re-registration procedure guarantees information storage about a registered domain name in DND during the next paid account period.

Delegation of the Administrator of the domain is suspended if the registration of a domain owner does not extend to the end of its validity. In the case of the renewal of registration to the time of its cancellation, the delegation of the Administrator of the domain is restored within 3 (three) working days.

Domain name registration is canceled Administrator, if it does not own the domain will be renewed within thirty (30) calendar days from the date of the termination of registration of the domain.

5.DOMAIN RE-DELEGATION PROCEDURE

The domain name Holder can re-delegate a domain name to another legal entity or another natural person via the Registration form at: www.domain.kg or based on the official letter from the domain name Holder and under the observance of the Regulations.

A letter can be send by email to: domain@infotel.kg or by fax at: +996(312) 66 34 34.

A legal entity or a natural person the domain name is re-delegated to shall perform the procedures given in paragraphs 2 and 3 of the Regulations.

6.COST OF SERVICES AND PAYMENT PROCEDURES

Cost of services for domain name registration or re-registration is calculated according to tariffs being in force on the date of payment (Supplement 2) without taking taxes into account*.

GOV.KG, MIL.KG domains are registered for public institutions only.

Renewal of lost password to administer the domain can be done on: www.domain.kg or upon the application from the domain name holder in written form.

Either form of payment (by transfer or cash) can be used both for legal entities and private individuals.

Domain Name Holder bears expenses for transferring funds.

Proforma Invoice for a .kg domain name registration (re-registration) and support services is to be sent to the email address specified in the domain name Holder contact information.

When completing a payment document the domain name Holder should:
- use banking particulars indicated in the issued Proforma Invoice;
- indicate the domain name, for which the payment is made, in column " Details of Payment".
It is admitted to pay for several domain names using one payment document, at the same time it is necessary to include the names of all domains payable in column "Details of Payment".

When making payment by transfer the domain name Holder has to notify the Administrator about the payment made by sending a copy of payment order (with indication of the domain name/domain names, a payee and payer particulars of the payment) by fax at: +(996) 312 66 34 34 or by email at: billing@infotel.kg.

The domain registration and re-registration payment date is considered to be the date the funds have been received at the Administrator account.

One can get the original Invoice for service payment at: 175 Sovetskaya Str., Bishkek, the Kyrgyz Republic.

In case of anticipatory refusal of the domain/domains, the domain name Holder has to notify in writing about the domain cancel but for all that the funds paid for registration are not paid back.

In case the domain name Holder fails to fulfill items 6.7 and 6.8 of the Regulations, there can be an untimely record of the payment made and even the domain deletion from Domain Name Database. In case of failure to fulfill the terms and conditions of the Regulations and for possible negative consequences for the Holder (domain name deletion) the domain name Holder is responsible for occurred consequences.

* - The domain name Holder is tax exempt in case of providing supporting documents. This information is considered to be valid for legal entities and private individuals located within the territory of Kyrgyzstan.
