Introduction
DNS (Domain Name System) is the system used by the Internet in order to delegate and universally use univocal names to make reference to the different equipment connected to the network. Both
humans and machines can thereby use names instead of IP address numbers. This results in great advantages, including the fact that names are easier to use and remember than numbers, and that this allows an organization
to make the names of machines, services, e-mail addresses, etc. independent from the concrete address numbers that at a given time may be assigned to their equipment as a function of changing aspects, such as the
network topology and the Internet access provider.
In technical terms, the DNS is a huge database hierarchically distributed throughout the Internet. There are many servers that interact with each other in
order to find and facilitate to the client applications contacting them the translation of a name to its related IP address, with which the intended connection can be made. Each portion of the database is replicated
in at least two servers. This guarantees an adequate redundancy.
The reason that led to the development and implementation of the DNS in the Internet was the huge growth in the number of connected machines.
Earlier, the association between names and IP addresses used to be made through a listing centrally kept in a single file (HOST.TXT) that had to be constantly updated with each new equipment that was connected and
that had to reside in each and every one of the computers connected to the Internet.
The DNS purpose is to allow a step-by-step search, both from an administrative and a technical point of view, of the
name system in the Internet through a hierarchical distribution of delegated domain names. The domains are administrative entities, whose purpose is to sub-divide the management load of a central administrator,
distributing it among different assistant administrators. These, in turn, may repeat the process if the size of the domain to be managed justifies it. In that way, different levels of assigned domain names can be
created, where each administrator assigns unique names to its level, guaranteeing thereby that any domain name can be formed by the juxtaposition (separated by dots ".") of the different domain names upwards in
the hierarchy until the last one (called DNS root or ".") is reached; for instance: machine.level3.level2.level1.
In the first level of the hierarchy, we find the "Top Level Domains" (TLD), which are
one for each country (2-letter domains related to the ISO-3166 code for each territory), plus the "special" 3-letter domains: "edu", "com", "gov", "mil", "org", "int" and "net". Generally speaking, the DNS hierarchical
structure tries to reflect administrative dependencies under a first geographical component (or by activity in the case of the "special" TLDs); for instance, a machine or service belonging to a department or branch
of an organization in Canada would be delegated a name such as: machine. department.organization.ca.
Each TLD has its own regulations about who can register a third-level domain name, what domain names
are allowed, what procedures must be followed in order to register a third-level domain name, etc. The fact that someone has fulfilled the requirements to register his domain name under a TLD does not mean that
he has fulfilled those established to register the same or another domain name under another TLD.
The main functions performed by PE-NIC include the registration of third-level Domain Names under
"pe" to be used in the Internet. This document includes the regulations and procedures governing the registration of third-level Domain Names under "pe".
PE-NIC only registers third-level Domain Names
under "pe" (e.g. "organization.com.pe"). The registration of names under "pe" including four lower levels or more (e.g. "www.organization.com.pe") must be carried out by the registration authority in the corresponding
parent zone and, consequently, the third-level domain name from which they depend must have been previously registered in and delegated by PE-NIC.
:: Policies for the delegation of Third-Level Subdomains
under TLD PE
The policy for the delegation of subdomains under the Top Level Domain PE is based on RFC1591 issued by the Internet Assigned Numbers Authority (IANA).
Considering paragraph
2 of such document, which states that the domain rights and property are inadequate and are rather aimed at community services, the TLD PE has been sub-divided into the following subdomains:
edu.pe
gob.pe
nom.pe
mil.pe
org.pe
com.pe
net.pe
The assignation of a domain name under such subdomains is based on the following criteria:
1. 1. The following domains will be
restrictively delegated. The applicant must fulfill not only the requirements mentioned in Chapter 2 but also specific requirements for each Subdomain.
edu.pe:
This subdomain is delegated only to
institutions of educational nature: universities, schools, institutes, etc.
gob.pe:
This subdominion assigns only to the dependencies or institutions pertaining to the Peruvian government, according
to the Directive "Practical standardses for the allocation of names of Dominion of the organizations of the Public Administration".
mil.pe:
This subdomain is delegated only to the agencies
of the Peruvian Armed Forces.
net.pe:
Delegation of third-level domain names under this subdomain will only be carried out if the applicant fulfills all the following requirements:
The
requesting party must an Internet Access Provider.
The requesting party must have physical presence in the country.
The requesting party must operate its own main nameserver.
It must have its own
Autonomous System Number (AS).
The network must have total independence from any other party to the network existing in the country as for its expansion and management policies.
Likewise, the requesting
party must have at least one direct connection with some ISP abroad.
2. 2. The following domains will be openly delegated, requiring the fulfillment of the regulations in Chapter 2 for their assignation.

DOMAIN NAME REGISTRATION CONTRACT
These are the terms and conditions governing the registration of domain names in the Country Code Top Level Domain for Peru. Consequently, this document overrules any previous
agreement set by the parties in relation to domain name registration. This agreement is based on the Peruvian laws.
1. RCP is the manager of the Country Code Top Level Domain for Peru. Consequently,
it is the only agency in charge of domain name registration and delegation to the organizations that so request it and that comply with the regulations and provisions in force on the subject matter.
2.
The beneficiary represents that he knows all the regulations and provisions in force for the delegation and registration of domain names under the Top Level Domain and that he expressly abides by them. They are
part of this document and can be found in http://www.nic.pe .
3. The beneficiary represents that it is the exclusive power of PE-NIC to delegate domain names, as well as to reject or revoke their registration.
4. This agreement will be in force during all the time that the domain name registration in favor of the beneficiary is kept in force.
5. The registration of a domain name will begin with
the application submitted by the beneficiary before PE-NIC, which must have attached the supporting documents in the case of a trademark, distinctive logo, trade name or any name on which a precedent right exists.
After the submittal of the application, there will be a 10-day term for oppositions posed by third parties against the registration of such domain name. If no oppositions exist or if having been posed they have
been solved, the application will be approved.
6. The registration application may be sent by e-mail, but it will require that the information be later sent through non-electronic means, upon reception
of the name registration application approval. It will be an obligatory requirement that within 30 days after the domain name approval this information be sent to PE-NIC. If this information is not sent, the domain
name registration may be revoked by PE-NIC.
7. Upon approval of his domain name registration application, the beneficiary must pay the amount set by PE-NIC for domain name registration. Such payment will
include the Sales Tax (IGV). The domain name delegation will become effective four (04) working days as from the date when PE-NIC receives the document evidencing the payment made by the beneficiary.
In
the event of partial payment or failure to pay the domain name registration fee, the delegation will not be carried out until the beneficiary pays the required amounts. If any of these situations lasts over thirty
(30) working days, all the procedures and payments made so far will become void.
Furthermore, the beneficiary must pay the maintenance fee with the frequency set by PE-NIC. In the event of partial payment
or failure to pay the domain maintenance fee within the set terms, PE-NIC will proceed to revoke such domain name registration and will annul all the procedures made by the beneficiary.
8. The beneficiary
represents that the domain name registration application does not damage any industrial, intellectual or similar rights of third parties. In any case, the beneficiary will be the only responsible for any event resulting
form the registration and use of the requested domain name. PE-NIC has the right to revoke a domain name registration that has been requested damaging the right of third parties.
9. The beneficiary commits
to:
a) Continuously use the registered domain name.
b) Timely pay the fee set by PE-NIC.
c) Fulfill each and everyone of the regulations related to domain management set by PE-NIC, regardless of
their nature, sense or application, as the only manager and regulator of the registration of domain names in Peru.
Furthermore, he commits to immediately comply with and respect the changes made by PE-NIC
on the registration policies.
Should the beneficiary find any of such changes unacceptable, he may request the annulment of his domain name registration. Failure to communicate any disagreement situation will
be considered as an acceptance of the new policies set.
d) Respect each and everyone of the terms of this agreement, as well as all the provisions outlined in clause 2 in the event that the process of
registration, change or deletion of a domain name be carried out by a third party.
10. PE-NIC will not be, on any grounds, responsible to the beneficiary or third parties for the changes that may result
from a request of data deletion, or for the changes that may result from a modification request. Consequently, the beneficiary will assume all the responsibility for the effects that may result from the above-mentioned
processes.
Likewise, PE-NIC will be by no means responsible to the beneficiary or third parties for the management of the Top Level Domain in Peru, the management and/or administration of domain name
registration, or the enforcement of this agreement and/or the provisions referred to in Clause 2 hereof.
11. The beneficiary explicitly empowers PE-NIC so that it may carry out the immediate deletion
of any registered domain name if: (i) it has been obtained through false information; (2) the RCP proves that it has been used against third parties, or (3) once the set deadlines are due, a situation of partial
payment or failure to pay persists in relation to the fees set by PE-NIC.
Likewise, PE-NIC may cancel the assigned registration whenever it may consider it appropriate, being enough for this to send a
written communication to the beneficiary fifteen (15) calendar days in advance.
12. If due to any event resulting from the assignation, change or elimination of the domain name, PE-NIC or any of its officers,
managers, advisors, agents, members of the Steering Board or employees is involved in any judicial or administrative action, proceeding or investigation, the beneficiary will hold him harmless and will refund PE-NIC
any sum that it may have been forced to pay due to such event, as well as any legal and other expenses that may have been reasonable incurred for the defense against such actions, proceedings or investigations.
NOTE: By the act itself of submitting the application, the beneficiary accepts all the terms and conditions contained in this form and abides by the regulations contained in http://www.nic.pe
regarding the procedures for the application, delegation, registration, change, and cancellation of domain names. Domain name delegation is subject to the acceptance by PE-NIC.
Procedure for Oppositions in Nic-Pe
Introducción
El siguiente documento expresa los lineamientos que tendrá el NIC.PE para resolver cualquier situación presentada ante la
oposición de un tercero ante una solicitud de registro de un nombre de dominio por cualquier persona.
Cuando una persona u organización presenta la solicitud de registro de nombre de dominio,
esta puede ir acompañada de diversos documentos que demuestren su interés sobre dicho nombre de dominio
En algunos casos dicha combinación de caracteres puede coincidir con una marca,
lema comercial, nombre de organización, u otros términos y combinaciones de caracteres sobre las cuales un tercero posea un derecho, es por ello que el NIC.PE ha establecido un período de diez
días (10 días calendario) de publicación en la web, para publicitar la solicitud.
De este modo cualquier tercero que considere posea un derecho sobre determinada combinación
de caracteres puede presentar, en dicho plazo, su oposición al registro de dicho nombre de dominio, sustentando su oposición en documentación que demuestre poseer un derecho sobre la combinación
de caracteres en cuestión.
Del Procedimiento
Cuando un tercero considere que la combinación de caracteres que alguna persona o institución este solicitando, vulnere
sus derechos adquiridos sobre una combinación igual a la que se solicita al NIC.PE, podrá presentar su oposición al NIC.PE, a la dirección comite@nic.pe, dentro de los diez días
(10 días) de su publicación en la web del NIC.PE.
La solicitud deberá incluir los siguientes datos:
Nombre del que presenta la solicitud
Dirección física
de contacto
Teléfono de contacto
Nombre de dominio al cual se opone
Interés en dicho dominio
Deberá adjuntar asimismo la documentación sustentatoria de su petición,
es decir registro de marca, lema comercial; ficha registral de Registros Públicos con el nombre de la organización (si fuere el caso), o la documentación que considere relevante para demostrar
su derecho.
En cuanto haya llegado al NIC.PE la oposición, se hará traslado de la misma al solicitante del dominio, sea por email o por fax dependiendo la forma como haya llegado la oposición
y/o los datos de contacto que haya colocado el solicitando en su solicitud de registro de dominio.
Se espera una respuesta por parte del solicitante fundamentando, si asi lo deseara, su solicitud de registro
de nombre de dominio, dentro de los cinco (5) días calendario siguientes al traslado.
Una vez realizado el traslado el NIC.PE tiene un plazo de 10 días calendario para dar respuesta a la
oposición presentada.
De los Acuerdos del NIC
El NIC.PE ha establecido un comité que revisará las peticiones individualmente.
En el caso que las oposiciones
no sean sustentadas, el procedimiento de registro del nombre de dominio continuará.
En el caso de presentarse una oposición fundada, se denegará la solicitud inicial de registro
del nombre de dominio. Aquella persona que presente la oposición podrá, en la solicitud de oposición, presentar su solicitud de registro del nombre de dominio.
En el caso que el registrante
y el tercero que presenta la oposición poseerán derechos sobre la combinación de caracteres, el NIC.PE tendrá una sesión con ambas partes involucradas, para resolver amigablemente
la controversia. En el caso de no llegar a un acuerdo, las partes involucradas podrán recurrir a cualquier instancia de resolución de conflictos. El NIC.PE suspenderá el proceso de registro
de un nombre de dominio en conflicto, hasta cuando se tenga pronunciamiento de la instancia a la cual hayan escogido las partes.
